CUPCCA (informal bidding)

The California Uniform Public Construction Cost Accounting Commission is under the umbrella of the California Uniform Public Construction Cost Accounting Act (CUPCCAA) (PCC22000 et seq.) and provides for alternative bidding procedures when an agency performs a public work by contract, within certain monetary thresholds (projects currently costing $15,000 or more as per per PCC20111(b)). A "Public Project" is defined under PC22002.

On September 29, 2024, Assembly Bill (AB) 2192 was signed into law, amending portions of CUPCCAA, effective January 1, 2025. The revised contract thresholds are detailed below:

  1. Public projects of $75,000 or less may be performed by negotiated contract or by purchase order per PCC22032(a), amended by AB2192.
  2. Public projects of $220,000 or less may be let to contract by the informal bidding procedures per PCC22032(b), amended by AB2192.
  3. Public projects of more than $220,000 shall be let to contract by formal bidding procedures per PCC22032(c), amended by AB2192.
  4. If all bids received are in excess of $220,000, the governing body of the public agency may, by adoption of a resolution by a four-fifths vote, award the contract, at $235,000 or less, to the lowest responsible bidder, if it determines the cost estimate of the public agency was reasonable per PCC22034, amended by AB2192.
